在外國取得勝訴判決，不代表可以直接查封台灣的財產。通常須先由台灣法院判斷外國判決是否終局、外國法院是否有適當管轄、敗訴當事人是否獲合法通知與陳述機會，以及結果是否違反台灣公共秩序。
跨境案件最常出問題的不是實體請求，而是被告名稱、送達程序、判決確定證明、譯本及認證。若在外國程序開始前就規劃台灣執行，可大幅降低日後遭駁回的風險。
Winning a judgment abroad does not automatically authorize the attachment of assets located in Taiwan. As a general rule, a Taiwan court must first review and determine whether the foreign judgment is final and conclusive, whether the foreign court possessed proper jurisdiction, whether the losing party received lawful service of process and a fair opportunity to be heard, and whether the enforcement outcome violates the public order or good morals of Taiwan.
During a cross-border litigation, procedural defects—rather than the merits of the substantive claim—are the most frequent causes of enforcement failure; these typically involve inconsistencies in the defendant’s name, improper service of process, lack of a certificate of finality, and deficient translations or notarizations/legalizations. Strategic planning for Taiwan enforcement prior to initiating the foreign proceedings can significantly mitigate the risk of a subsequent dismissal.

Document Procurement: Obtaining the final, conclusive judgment and all corresponding proofs of service.
Translation & Legalization Evaluation: Completion of certified Chinese translations and evaluation of notarization/authentication requirements.
Judicial Recognition: Petitioning the Taiwan court for the recognition of the foreign judgment or for an enforcement order.
Compulsory Enforcement: Initiating compulsory execution proceedings upon securing a valid title of execution.
